Terms of Use
The terms under which you access and use MotiveIQ.
1. Introduction
These Terms of Use ("Terms") govern your use of MotiveIQ ("the Service"), operated by Horizon IT & Business Consultancy Limited ("Horizon", "we", "us").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Subscription terms
The Service is provided on a subscription basis. The subscribing organisation's owner account is included at no additional cost and may capture customer conversations.
Each paid Sales Intelligence Licence permits one additional Admin or User account to capture customer conversations, voice notes and observations. Each paid licence may be assigned to a maximum of two development sites.
Included Viewer accounts (such as Sales Managers, Regional Directors, Managing Directors and other reporting users) may access dashboards and reports at no additional cost but cannot capture or edit customer intelligence, subject to these Terms.
3. Monthly and annual billing
Subscriptions are offered in the currency selected at checkout. Current standard prices per paid Sales Intelligence Licence are £29, $38 or €33 per month, or £299, $392 or €340 per year.
Monthly and annual subscriptions renew automatically unless cancelled. The full price, billing frequency, currency and number of paid licences are displayed before payment and recorded by our payment provider.
Prices are exclusive of applicable taxes, which will be added where required.
4. Cancellation policy
Monthly and annual subscriptions may be cancelled at any time through the account billing settings. Cancellation takes effect at the end of the current paid billing period, and access continues until that date.
A cancellation may be withdrawn before the end of the current billing period. Refunds for partial periods are not provided, except where required by law.
Cancellation does not currently trigger automatic deletion of customer conversation data. Following cancellation, the subscribing organisation may request deletion of eligible data by contacting us, as set out in our Privacy Policy. Billing records are retained as required for UK tax and accounting compliance.
5. User responsibilities
You are responsible for:
• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Ensuring that users within your organisation use the Service in accordance with these Terms.
• Ensuring you have appropriate consent to capture and process customer conversations.
You must provide accurate and complete information when registering and must keep your information up to date.
6. Acceptable use
You must not:
• Use the Service for any unlawful purpose.
• Capture or upload content that infringes the rights of any third party.
• Attempt to gain unauthorised access to the Service or its systems.
• Use the Service to store personal data in breach of applicable data protection law.
• Resell or sublicense access to the Service without our prior written consent.
Horizon reserves the right to suspend or terminate access where we believe these terms have been breached.
7. Intellectual property
Horizon retains all intellectual property rights in the Service, including software, design, branding, and documentation.
You retain ownership of all customer conversation data and content you capture through the Service. You grant Horizon a limited licence to process that content solely to provide the Service to you.
Aggregated, anonymised insights derived from data across multiple customers may be used by Horizon to improve the Service, provided that no individual or company can be identified.
8. Availability of the service
We aim to provide a reliable Service and work to maintain high availability. However, we do not guarantee uninterrupted access. Scheduled maintenance, updates, and circumstances beyond our reasonable control may cause temporary interruptions.
We will use reasonable efforts to notify you of significant planned downtime.
9. Limitation of liability
To the maximum extent permitted by law, Horizon shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you have paid for the Service in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.
10. Governing law
These Terms are governed by the laws of England and Wales. Horizon IT & Business Consultancy Limited is registered in England and Wales with company number 13613263. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
